500px Returns To The iOS App Store, With Mature Content Warning And Photo Reporting Button

500px-iconToronto's 500px got its popular photo sharing iPhone app back on the iTunes App Store today, following a takedown that Apple said stemmed from multiple user complaints about pornographic material. The app returns with an age-gate warning, advising that the content in the app is for 17+ audiences, and also adds a new "Report Photo" button to help users quickly tag things they find offensive for potential removal from the network.

But who says new construction homes don't need inspecting?

Take a look at the following pictures very carefully.

What I am hoping you will notice is that the handle on the hot side is in a different position in each photo.?

In the first picture the hot water is turned off and we can see the ?cold water? temperature is 41.2 degrees F.

In the second picture the hot water is turned on and we can see the ?hot water? temperature is 41.0 degrees F.

Whoops.

It is actually a little hard to imagine how this could happen, but it is another in an endless list of reasons to get new construction inspected.

Turning on the taps for that nice relaxing bath on move-in day might leave the home owner a little ?cold.?? And the call to the agent and inspector might not be too warm either.?

On this particular home I found this issue particularly interesting because water temperature at all of the other taps was 158 degrees F.

For those of you that have been living under a log---158 degrees is WAY too hot and will cause 2nd and 3rd degree burns in less than a second.?

Modern fixtures to showers and tub/shower combos are required to be regulated such that these kinds of temperatures cannot be reached?even if the water heater is set too high.? Temperature control devices for this new construction home were either missing or not adjusted properly.

But who says new construction homes don?t need inspecting?

Hydration backpacks have made carrying water during many sports much easier. For some other sports, however, the hydration pack isn't that much more convenient than a water bottle. When it comes to skiing, hydration packs freeze easily and can be uncomfortable on a chairlift. Camelbak has a new design that promises to make hydration more ski-friendly.

The new Bootlegger hydration pack is designed to be worn underneath a ski jacket, rather than over it like any other backpack. The idea is for it to be closer to your body, where your core temperature will prevent the 50 fluid ounces (1.5 L) of water from freezing. The breathable mesh harness is designed to prevent it from becoming too hot and sweaty.

CamelBak claims that the design is streamlined specifically for lift-served skiing and snowboarding, so it should be more comfortable to wear on the chairlift.

The company also sells the PowderBak vest, which is a 70-ounce (2 L) hydration system integrated into a softshell vest. Introduced in 2009 as the ShredBak, the vest has a similar aim of keeping water close to the body for anti-freezing warmth and lower-profile carrying.

I used to use a small CamelBak pack regularly for resort snowboarding. While it was easier to carry than a water bottle, the combination of discomfort on the lift, occasional freezing and irritation of cleaning out the bladder led me to go back to carrying a water bottle in my jacket pocket. Assuming this new design is effective at adding comfort and anti-freezing, it may be worth looking into. I'm hoping to get a sample to test out on the slopes and report back.

The Bootlegger will launch in September for US$55.

(AP) ? CBS says the big reveal is coming for "How I Met Your Mother."

The network said Wednesday the sitcom will air its ninth and final season next fall.

And CBS Entertainment President Nina Tassler promised that TV's "most mysterious mother" will be unveiled as the show wraps up.

That would be the mystery woman with whom Ted, played by Josh Radnor, ultimately has a family.

The sitcom's cast also includes Neil Patrick Harris, Cobie Smulders, Jason Segel and Alyson Hannigan.

20th Century Fox Television says all the actors will return for the 2013-14 season.

Insight: Apple's grip on carriers, suppliers loosens

SAN FRANCISCO (Reuters) - Apple Inc's shareholders have been hit by one of the bloodiest weeks in the history of the stock, but wider fallout from such weakness might be more important to the long-term value of their investments.

While Apple's iPhones, iPads and Macs remain gold standards, signs the company is losing some of its edge in the smartphone market suggest its clout with business partners could wane.

Recent comments from executives at phone carriers and component suppliers show they see room for at least some shift in the balance of power.

In particular, a move by No. 4 US mobile service provider T-Mobile USA to stop subsidizing smartphones around the time it starts selling the iPhone in three months time may put pressure on Apple, especially if other carriers follow the example.

U.S. phone companies mostly subsidize handsets in return for two-year contracts. If customers start paying the full price for an iPhone they might look for cheaper alternatives.

Asked whether carriers are now in a better position to negotiate lower prices with smartphone makers such as Apple, Fran Shammo, chief financial officer of Verizon Communications, said having four strong platforms - Apple, Android, Windows and BlackBerry - is leading to more competitive pricing.

"The more operating systems we have to compete in this area the better the competition," he told Reuters.

Verizon Communications Inc is the majority owner of Verizon Wireless, the biggest U.S. mobile provider.

LOWER GROSS MARGINS

Apple sold a record 48 million iPhones in the December quarter, but its share of the overall market is expected to peak this year at 22 percent and become dependent on repeat business from loyal customers unless it accepts lower margins by making low-cost iPhones, according to ABI Research.

Meanwhile, arch-rival Samsung Electronics Co Ltd, with a range of handsets has overtaken Apple as the world's top smartphone seller.

If Apple's customers and suppliers, let alone rivals, smell blood and take a much harder line in negotiations, it could erode Apple's gross margins, which slipped to 38.6 percent in the last quarter from 44.7 percent a year ago.

Apple declined to comment on its business with partners, although when CEO Tim Cook was asked on an earnings conference call last July about subsidies potentially being reduced, he said the total subsidy carriers pay is fairly small compared with revenues over a two-year contract. He also said carriers told him the iPhone has many advantages, including lower churn rates and the ability to sell shared data plans for other Apple products such as the iPad.

Certainly, Apple's astounding run over the past decade and ever rising volume of iPhone sales have given it unrivaled power to negotiate with wireless carriers and component suppliers.

Last week's results fell short of Wall Street's estimates, sending Apple's share price down more than 14 percent. That underscored signs Apple is coming back down to earth, transforming from undisputed Wall Street darling to a more normal - if enormous and hugely profitable - company.

A less powerful Apple could be welcomed by telecommunications carriers and component suppliers that have grown accustomed to the tough terms Apple was able to exact thanks to its massive scale and leadership in the market.

Wireless carriers that once agreed to unfavorable contracts and hefty subsidies still cannot live without Apple, but experts say they could have more leeway in the future if Samsung and other device makers continue to grab market share.

HAS BEENS

Subsidies have been a major driver of the iPhone's success and in boosting Apple's earnings. Analysts estimate operators pay a roughly $400 subsidy for each iPhone they sell in comparison with subsidies of $250 to $300 for other smartphones.

But that may already be changing. T-Mobile USA, a unit of Deutsche Telekom AG, has not disclosed the details of its deal with Apple, but CEO John Legere said it will not be as onerous as Sprint Nextel's commitment to pay $15.5 billion over four years. Instead of subsidizing smartphones, T-Mobile USA will let consumers pay the full price in monthly installments.

Randall Stephenson, CEO of AT&T, Apple's first partner for the iPhone, applauds T-Mobile USA's idea.

"That's something we've looked at on several occasions. I kind of like that idea," Stephenson said. "It's something we're going to be watching."

Verizon CEO Lowell McAdam told Reuters T-Mobile USA's strategy is "very intriguing," but wondered if consumers are ready to pay full price. An iPhone 5 with 16 gigabytes of storage that is not tied to a contract costs $649 on Walmart.com.

If subsidies are removed and payment plans widely adopted, some experts say consumers might opt for cheaper devices.

"The illogical love affair is over. Now it's just a great company," said a former top executive for a rival in the handset business. "The AT&Ts of the world will start to try to get themselves weaned off of paying such great subsidies to Apple."

In content, there are already signs of resistance. The company is meeting media executives in a potential effort to transform the living room with some kind of new Apple TV product, sources have said.

Its efforts are hindered, however, by the reluctance of movie and TV program makers to make content deals favorable to Apple. They saw how Apple's iTunes service helped decimate recording industry profits some years ago and they are very wary as a result, sources and analysts say.

Samsung led the global smartphone market with 29 percent market share in the fourth quarter, up from 22.5 percent a year ago. Apple was No. 2, but its share fell to 21.8 percent from 23 percent a year ago, according research firm IDC.

Apple's ability to extract low prices from the makers of chips and other components is one of the reasons it preserves margins in the 40 percent range on average.

But given increasing competition in the United States and its relatively weak position (sixth in smartphone sales) in the rapidly growing China market, that power might be hard to keep.

Supplier stock prices surge or plummet as result of being chosen or rejected by Apple. Chipmaker Audience Inc went public last year on the back of its Apple business, but the stock plummeted when Apple stopped using its chips. Audience's largest customer is now Samsung and its stock is recovering.

An executive at one chipmaker welcomed the prospect that one day his company might depend less on Apple.

Selling to Apple is "a double-edged sword," said the executive, who was not authorized to discuss his company's relationship with Apple. Having Apple as a customer guarantees huge volumes, but comes at the cost of accepting rock bottom prices that can cripple profit margins, the executive said.

Meanwhile, a few component makers are staking out territory in smartphones and tablets without Apple.

InvenSense Inc reported a 58 percent jump in quarterly earnings last Wednesday and its stock leaped 11 percent, partly because its gyroscope chips are used in hot-selling Android devices, including the Google Nexus 7, Samsung Galaxy S3 and Amazon Kindle Fire HD.

To be sure, InvenSense is trying to win Cupertino, California-based Apple's business. But even without Apple, it has become a key supplier in the smartphone and tablet market.

But as Samsung's share of the smartphone market grows further, it too is forcing suppliers to accept lower and lower prices, said Evercore Partners analyst Mark McKechnie.

"Samsung beats the heck out of people too. Be careful what you wish for," McKechnie said.

CULT STATUS

For now, Apple is still a mega player, even if it ships fewer phones than Samsung. For many consumers, its cult-like status remains unchallenged.

Despite recent stock market losses - more than $230 billion has been wiped off Apple's value since its September peak - the iPhone alone pulled in $30.66 billion in revenue last quarter, 43 percent more than Microsoft's entire sales for the period.

"Even though they're not gaining share, they're such a large piece of the market and such a driver of customer volume into their stores that people can't walk away yet," said David Yoffie, a professor who specializes in competitive strategy at Harvard Business School.

"Over the longer term, clearly there will be more and more pressure on Apple if they don't find new ways to innovate."

Even with slower growth, Apple is still widely seen as a highly successful company with a bright future and plenty of potential to produce another revolutionary product.

"What rabbit will Apple pull out of its hat to once again transform the industry?" asked Joseph Doyle, who co-manages wealth management firm Morris Capital Advisors' large cap strategy. "And if they can't do it, does that make it an awful investment? No, that will make it more like everything else."

Antigua gets OK to become copyright haven

(AP) ? Americans call it piracy. Antiguans call it justice.

The islands of Antigua and Barbuda are threatening to strip intellectual property protections from American goods as part of a long-running trade dispute over the U.S. embargo on the tiny Caribbean nation's online gambling industry.

U.S. officials say the proposed copyright haven - whose broad outlines were approved Monday at the World Trade Organization in Geneva - amounts to "government-authorized piracy." But Antiguans, who've won a series of legal victories against the U.S. at the international trade body, reject any suggestion that they're pirates.

"We have followed the rules and procedures of the WTO to the letter," Antigua's high commissioner to London, Carl Roberts, said in a statement Monday. "Our little country is doing precisely what it has earned the right to do under international agreements."

The U.S. and Antigua have been tussling for years over the ability of Americans to use online casinos based in the Caribbean nation. U.S. laws have long been interpreted to mean that Internet gambling is illegal if it crosses state lines.

The World Trade Organization, however, has come down on Antigua's side. In 2007, it allowed the islands to draw $21 million a year's worth of "nullification or impairments" from the United States as a penalty for the continuing refusal of the U.S. to allow American customers to place their online bets in Antigua.

Antiguan officials say they could make up the money through the operation of a copyright haven, although what that might look like and what its scope would be remains unclear. Antiguan officials have kept details vague and the move has little precedent.

Observers have suggested, for example, a subscription service to access copyright-free American music, or a pay-per-download site that charges pennies for Hollywood hits.

Mark Mendel, a lawyer for Antigua's government, cautioned that whatever ends up being set up, it wouldn't be an Antiguan version of The Pirate Bay, the free-for-all file sharing site whose name has become synonymous with illegal downloads.

"We aren't going to be flaunting the rules," he said in a telephone interview last week. "It's not piracy if you have the right to do it."

Right or wrong, American businesses aren't happy with the idea. Gina Vetere, with the U.S. Chamber of Commerce's intellectual property center, said such a move would only exacerbate the dispute and "sour the business environment."

The haven may still never see the light of day; Mendel said Antigua's goal remains a negotiated settlement with U.S. authorities over the gambling dispute.

Even if such a haven were set up, international fans of free downloads may want to exercise caution. Antiguans may be allowed to download freely, but for those outside the country the legal regime remains murky.

Nevertheless, the notion of a country of 89,000 people standing up to the powerful United States on intellectual property matters has caught the imagination of many - especially those who believe that U.S. copyright rules are too restrictive.

"It's time for small countries to be treated fairly in these organizations," said Mendel.

Scientists with NASA's planet-hunting Kepler spacecraft have revamped the mission's online archive of alien worlds, opening up the database for the entire world to see.

Researchers are now posting all exoplanet sightings by the Kepler observatory into a single, comprehensive website called the "NASA Exoplanet Archive." Instead of going through the long planet confirmation process before making data publicly available, since December of last year, scientists have started shoveling out all the data Kepler collects into a comprehensive list.

"When we make that list, right away it goes to the archive," Kepler mission team member Steve Howell told SPACE.com during the 221st American Astronomical Society meeting in Long Beach, Calif., this month. "So the day we know about the list, the archive knows about the list. And then everybody, including us, can work on that list. But that list is dynamic so if we, or a community person, makes an observation and says, 'Hey, I looked at this planet candidate but it's really an eclipsing binary,' then that entry in the archive will be changed."

The archive has information about the size, orbital period and other metrics of any possible planet discovered and investigated by Kepler.

"It's all in real time," Howell said. "The sausage-making process is exposed."

Before the new archive was debuted, astronomers were already doing creative work with the data. One created a visually stunning video of every known Kepler planet candidate ? 2,299 unconfirmed exoplanets at the time ? orbiting one central point.

The Kepler team?s new "open" attitude toward data release is giving everybody, not just members of the scientific community, a chance to do some hands-on scientific research by building their own experiments, Howell said.

A group of high school students has already taken data from groups of planets observed by Kepler and mapped them against a map of known stars looking for a pattern. Howell doesn?t think they'll see much, but he's glad that they have the opportunity to get creative.

"The entire world can help us with this Kepler data," Howell said. "I don't see any downside."

?Planet Hunters, a collective of amateur astronomers, recently found 42 new alien planets using Kepler data that was publicly available prior to the launch of the new archive system.

It would be difficult for Kepler scientists to get their jobs done without the help of amateur astronomers around the globe, mission researchers said. By making the exoplanet archive more accessible, it could mean that more planets are found and confirmed in shorter amounts of time than ever before.

More people sifting through the wealth of data collected by Kepler means that scientists have a better chance of finding even more planets circling distant stars, Howell added.

Since its launch in 2009, NASA's Kepler spacecraft has flagged more than 2,300 objects as possible alien worlds. Although only about 100 have been confirmed, scientists expect that at least 80 percent could be certifiable exoplanets.

Currently, Kepler has entered a "safe mode" after researchers spotted an issue with one of the spacecraft's three reaction wheels that are responsible for orienting the telescope. The malfunction has stalled science observations, but researchers hope that the issue will be resolved by Sunday (Jan. 27).

    Iran and world powers need to stop bickering: Russia

    MOSCOW (Reuters) - Global powers and Iran should "stop behaving like little children" and agree a date and place for new talks on Tehran's nuclear program, Russian Foreign Minister Sergei Lavrov said on Monday.

    European officials have accused Tehran of stalling on arranging a meeting with the six nations, including Russia, that are trying to prevent Iran developing atomic weapons. Tehran says its nuclear program is entirely for peaceful purposes.

    "Some of our partners in the six powers and the Iranian side cannot come to an agreement about where to meet," Lavrov told a news conference after talks with Belgian Foreign Minister Didier Reynders.

    "We are ready to meet at any location as soon as possible," Lavrov said. "We believe the essence of our talks is far more important (than the site), and we hope that common sense will prevail and we will stop behaving like little children."

    Three rounds of talks in the first half of last year between Iran and the six powers - Russia, the United States, China, Britain, France and Germany - produced no breakthrough, increasing speculation Israel could attack Iranian nuclear installations.

    Talks had been expected to resume after the U.S. presidential election, possibly as early as this month. An Iranian news agency reported this month that talks might resume on January 28 and 29, but the EU said there was no agreement.

    PARK CITY, Utah (AP) ? The dramatic film "Fruitvale" and the documentary "Blood Brother" won over audiences and Sundance Film Festival judges.

    Both American films won audience awards and grand jury prizes Saturday at the Sundance Awards.

    "Fruitvale" tells the true story of Oscar Grant, who was 22 years old when he was shot and killed in a public transit station in Oakland, Calif. Twenty-six-year-old first-time filmmaker Ryan Coogler wrote and directed the dramatic narrative.

    "Blood Brother" follows a young American, Rocky, who moved to India to work with orphans infected with HIV.

    The Cambodian film "A River Changes Course" won the grand jury prize for international documentary, and a narrative film from South Korea, "Jiseul," claimed the grand jury prize for dramatic world cinema.

    San Francisco Film Noir Festival: Noir City Heads To Castro Theatre

    The Steve Jobs film is apparently "embarrassing," "Fruitvale" doesn't have a release date yet and, with the recent will-they-or-won't-they intrigue surrounding the release of "The Canyons," our movie-going hearts just can't take it anymore.

    Thankfully, there's the San Francisco Film Noir Festival, Noir City.

    Starting Friday night, the Castro Theatre will host its annual ode to noir. And with 27 films, they're bringing all the suspense, intrigue and betrayal you can handle.

    The theatre will kick off the festival will a special guests appearance from noir star Peggy Cummins who will introduce her 1950 film "Gun Crazy," and then stick around for a post-show interview. After that, it's a week and a half of all-day noir. (Eat your heart out, Sundance.)

    Kumbh Mela: A million man dip

    The Hindu festival is billed as the world's largest gathering, a chance to wash away karmic debt and liberate oneself from the cycle of rebirth and death.

    This week,?Hindu ascetics in ostentatious chariots pulled by elephants and horses along with pilgrims and tourists from around the world arrived in Allahabad, about halfway between New Delhi and Kolkata, India.

    Their faces smeared with ash and bodies covered in little more than marigold garlands, the religious men marked the opening of the Kumbh Mela, by rushing into the cold water to bathe at 5 a.m. on Monday.?

    The Hindu festival is billed as the world's largest gathering, a chance to wash away karmic debt and liberate oneself from the cycle of rebirth and death. It's also a broadly shared experience in a country where the saying goes that there are as many Indias as there are Indians.?

    "What is most endearing about the Kumbh festival is that all Hindus across caste and class come together. All hierarchies melt in the great river. It's unity in diversity," says Ram Naresh Tripathi, a retired journalist and Hindu astrologer?in Allahabad.

    This is one of four Kumbh Melas, each held in different cities over different intervals???this one comes to Allahabad every 12 years. These festivals?are all miraculous, at the very least in terms of logistics.

    On Monday's opening, at least 10 million people bathed in the?sangam,?or confluence, of three rivers, the Ganga, the Yamuna, and the Saraswati.?By the end of the festival on March 10, an estimated 100 million people will have bathed in the river. Feb. 10 is the day considered most?auspicious?by religious followers, and is therefore the busiest day.

    A temporary tent city has been set up on 6,000 acres of land, and the Indian Railways is running 750 special trains to make sure people from different parts of the country can reach it. ??

    The numbers indicate the scale of the exercise: 18 pontoon bridges, 35,000 toilets, 97 miles of new roads, 355 miles of water pipelines, 497 miles of electric wires, 48 power sub-stations, four warehouses for grains, groceries and vegetables, 22 doctors, 120 ambulances, 30 new police stations, 100 beds for local hospitals and so on, according to Mela Officer Mani Prasad Mishra.

    At a press conference addressed, journalists complained about incomplete work, to which Mr. Mishra replied that the authorities had been rushing against time. "We are in control of the situation and whatever requirements are needed to conduct it successfully have been put in place," he said.

    The government has taken measures to fight contagious diseases, expected stampedes and fires, and terrorist attacks. Some 30,000 policemen are patrolling the Kumbh, which is under the surveillance of 56 watchtowers and 89 CCTV cameras. A market made up of 11,000 stalls has been set up to sell everything from food to?ornaments and curios.

    The festival cost an estimated $290 million to organize, but a study by The Association of Chambers of Commerce and Industry in India says the Uttar Pradesh state government is likely to recover most of it through revenues generated by tourism.

    Tourists and pilgrims are expected from across the world. Among the expected visitors: The Tibetan spiritual leader the Dalai Lama, and actors Richard Gere, Michael Douglas, and his wife Catherine Zeta Jones.

    Mr. Tripathi, the journalist-turned-astrologer, said the Kumbh had changed a lot since his childhood, with the gathering now catering to Hindus with newfound wealth. ?The?sadhus?[ascetics] have all become hi-tech. They used to come on foot from hundreds of miles away but today they come in cars and carry gadgets like tablet computers,? he says.

    A &#39;knowing-doing&#39; gap exists in global business

    Most businesses know of the benefits of team building and the way these sort of exercises and courses can improve the morale of their team. However, in spite of this, many do not act on it, and risk the loss of productivity and togetherness within their firm.

    Team building can be of essential importance to any firm, particularly at the start of any new year. With Christmas out of the year for another 12 months, there is a risk of workers feeling blue and low, lowering their productivity, if they do not feel the camaraderie within their office.

    In addition to this, global firms have to deal with the fact that there is often an increase in the number of people who are looking to find a new job and a new start in January each year.

    By making sure that they have trained everyone and made them feel like a valuable part of an effective unit though, business will improve their chance of retaining the staff members that they have on their books.

    Paul Matthews, managing director and founder of People Alchemy Ltd, said though that there is an attitude to team building that is similar to that seen with regards five fruit and veg a day; everyone knows that they should do it, but few do.

    He explained that this represents a "knowing-doing gap" that needs to be addressed in order to make sure firms are performing to the best standards and that everyone therein feels valued and needed.

    "There is also a history around team building in the corporate market that many people think of as away days doing outdoor stuff like using a pile of ropes and barrels and planks to cross a small lake. These can work if facilitated well, but can also fail badly. The key for any team building is expert facilitation to draw the lessons out of the exercises. Facilitation is far more important than the exercise itself," Mr Matthews added.
