Romney, Obama ramp up attacks on economic records

REDWOOD CITY, Calif. (AP) ? President Barack Obama's campaign is ramping up criticism of Republican Mitt Romney's record in Massachusetts, while the Republican nominee is contrasting his record in the private sector with the Obama administration's support for green energy companies.

Romney on Wednesday night regaled California donors with the story of Staples, one of the companies backed by the private equity firm he used to run. Bain Capital started by investing a few million dollars, Romney said, while Staples executives worked out of Spartan offices furnished with old Naugahyde chairs.

It looked a lot different, Romney said, than the glass-walled headquarters the green energy company Solyndra built and maintained with the help of federal loan guarantees before it went bankrupt last year.

"This was real people's money," Romney said of the Staples investment. "It wasn't taxpayers' money."

Romney planned a campaign appearance in northern California Thursday morning.

Obama's campaign released a web video Thursday highlighting local Massachusetts officials who criticized Romney for not making good on his promises to grow the state's economy. The state was 47th out of 50 in job growth during his tenure as governor, though the unemployment rate dropped.

"He cut programs essential to the middle class like manufacturing and education, while giving special breaks to the wealthiest," Obama spokesman Ben LaBolt said.

Top Obama strategist David Axelrod planned to appear Thursday in Boston, where Romney's campaign is headquartered, to criticize Romney's record as governor.

In a memo released Wednesday, Axelrod wrote, "Under Gov. Romney, the Massachusetts economy was not at the top or even in the middle, but close to the bottom of all the states."

Appearing Thursday morning on NBC's "Today" show, Axelrod promised the Obama campaign will focus closely on Romney's record as governor. He said Romney "offers himself as an economic guru and savior," but the facts don't support that.

Axelrod denied that Obama, who campaigned four years ago on a theme of hope and opportunity, is merely trying to lengthen his hold on the White House. "I don't think what he's interested in is staying in power," Axelrod said. For months, Obama and his allies have signaled plans to target Romney's Massachusetts record, with advisers noting that the state's economy lagged in job creation and saw an increase in debt while he was governor. The critique builds upon a line of attack this month of Romney's record at Bain Capital, which Obama's team contends led to job losses and bankrupt companies even while Bain profited.

"Whether companies succeeded or failed, Romney Economics netted huge profits for him and his investors, but sometimes proved devastating for the middle-class workers whose jobs, benefits and pensions were put at risk," Axelrod wrote.

Republicans contend that Obama's critique of the Bain record will backfire because it will give voters the impression that he is anti-business.

Romney's campaign has signaled it will ramp up focus on Solyndra and other green energy companies that received taxpayer help but struggled to perform. Solyndra received $535 million in loan guarantees from the Energy Department in 2009, and Obama spoke at the company's Fremont, Calif., headquarters in May 2010, saying the company represented America's energy future.

In August 2011, the company went bankrupt, laying off 1,100 workers and shuttering its offices.

Solyndra's woes are an example of "what happens when the government puts hundreds of millions of dollars into an enterprise," Romney said, telling supporters that the government money actually discouraged solar energy because it made other entrepreneurs less likely to try to enter the market.

The Republican Party posted a web video Thursday criticizing the Obama administration's investment in Solyndra. "So, President Obama ignored many warnings and made risky bets with taxpayer dollars only to see more people lose their jobs, health care and pensions," an announcer says in the video.

Republicans say Obama essentially played the role of venture capitalist by investing government money in green energy companies. And Romney said Obama hasn't done well in that role.

"He invests in something like Solyndra and puts in half a billion in a business like that, and I look and think, 'Gosh, when we started Staples, the office superstore, I think collectively we put in a few million dollars.' And then when it had a little success, we put in more," Romney told California donors.

Misuse of over-the-counter pain medication is potential health threat

ScienceDaily (May 30, 2012) ? A significant number of adults are at risk of unintentionally overdosing on over-the-counter (OTC) pain medication, according to a new study in the US by Dr. Michael Wolf, from Northwestern University in Chicago, and his colleagues. Their work, looking at the prevalence and potential misuse of pain medication containing the active ingredient acetaminophen as well as the likelihood of overdosing, appears online in the Journal of General Internal Medicine, published by Springer.

Many adults in the US regularly use OTC pain medication containing the active ingredient acetaminophen, the most commonly used OTC pain medication in the US. They take it either on its own or in combination with other drugs, which may also contain acetaminophen. The ease of access to OTC drugs presents a challenge to patient safety as many individuals may lack the necessary health literacy skills to self-administer these medicines appropriately. Indeed, individuals make independent decisions that match an OTC product to a self-diagnosed symptom or condition. Worryingly, acetaminophen overdose is the leading cause of acute liver failure.

Wolf and colleagues interviewed 500 adult patients receiving care at outpatient general medicine clinics in Atlanta and Chicago between September 2009 and March 2011. Over half the patients reported some acetaminophen use and 19 percent were 'heavy users' i.e. they had taken it every day, or at least a couple of times a week, during the previous six months.

The researchers tested whether these patients understood the recommended dosage and were able to self-administer OTC acetaminophen appropriately. Firstly, could they work out the proper dosing of a single OTC medication over a 24-hour period? Secondly, what was the risk of patients 'double-dipping', or simultaneously taking two acetaminophen-containing products, and thereby exceeding the recommended dose?

To assess proper dosing, the participants were given five OTC drug bottles and, for each one, were asked to imagine that they took the first dose at time X, and wanted to take the maximum dose of this medicine in one day. They were then asked to show the researcher how many pills and at which times they would need to take them for a full 24-hour day.

To assess 'double-dipping', the patients were told to imagine they were taking a maximum dose of a primary OTC drug and asked whether it would be safe to also take a second medicine with the primary medicine -- both of which contained acetaminophen.

Wolf and team found that nearly a quarter of the participants were at risk of overdosing on pain medication using a single OTC acetaminophen product, by exceeding the dose of four grams in a 24-hour period; 5 percent made serious errors by dosing out more than six grams. In addition, nearly half were at risk of overdosing by 'double-dipping' with two acetaminophen containing products.

The authors conclude: "Our findings suggest that many consumers do not recognize or differentiate the active ingredient in OTC pain medicines, nor do they necessarily closely adhere to package or label instructions. Given the prevalence of the problem, risk of significant adverse effects, and lack of a learned intermediary i.e. a physician to guide decision making and counsel consumers on proper use, we believe this to be a serious public health threat requiring urgent attention."

Jersey Shore Shark Attack Trailer: The Worst (Best) Film of All Time?

Jersey Shore is all the rage these days. Ditto shark attack movies.

With that in mind, the geniuses at Syfy decided to blend the two phenomena, and the result is this amazing cinematic achievement premiering June 9.

The title Jersey Shore Shark Attack really speaks for itself, but you need to watch the trailer below to see Garden State preparing to be eaten alive:

Syfy's hilariously official synopsis for the movie - which even features a cameo from Jersey Shore's own Vinny Guadagnino - is as follows:

"Many years ago, hundreds of locals and tourists were massacred by giant man-eating sharks in the infamous 1916 Jersey Shore attacks."

"But that's just a legend... or is it?"

"It's a holiday weekend on the Jersey Shore and, unbeknownst to anyone, underwater drills have attracted dozens of albino bull sharks to the pier."

"When a man goes missing, TC (The Complication), Nookie and friends fear the worst and plead with the police chief to close down the beach."

"It isn't until a famous singer is eaten alive during a performance on the pier that a shark hunt begins. Now, the Preppies must work together with the Guidos in order to save the Jersey Shore and its inhabitants from another vicious slaughter."

Maksim Chmerkovskiy and Peta Murgatroyd: New Couple Alert?

Dancing With the Stars' Maksim Chmerkovskiy was photographed kissing fellow pro dancer co-star Peta Murgatroyd this weekend, sparking rumors of romance.

On Saturday at the Encore Beach Club in Las Vegas, Maksim was there celebrating with Peta, who won Dancing With the Stars with Donald Driver last week.

That wasn't the only time the hard-bodied pair and rumored couple were spotted together in Sin City. Witnesses have seen them together all over Vegas.

And, at the opening of Chmerkovskiy's new dance studio in Connecticut on May 23, the pair stood arm-in-arm while he whispered in her ear. Hmm ...

Peta Murgatroyd PictureMaksim Photo

"She's had a crush on him for a long time," a source tells People of Peta. "They are really great together. And he is very happy. It's early but I think this will last. They're a great match, a good couple. She says they're not dating but they are. Everyone knows it."

Still, at the debut of the Dance With Me studio (which Maks opened with his brother Val and fellow pro Tony Dovolani), both danced around questions.

"I'm here to support Maksim," was all Murgatroyd would say about Chmerkovskiy, who wouldn't directly address the nature of their relationship either.

"I try to keep certain things private just because – what's a politically correct way of saying it? It's none of anybody's business," he said. "It's very intimate and personal."

Yeah. They're totally doing the horizontal Argentine tango.

The Flame Virus: Spyware on an Unprecedented Scale | Tech Toinks!

Security researchers recently discovered one of the most complex instances of computer malware on record. Flame, which also goes by the names SkyWiper and Viper, has infected hundreds of computers across the Middle East and Europe. What does it do? Where did it come from? Who unleashed it?

What makes Flame so unusual is its size. It?s much larger than some of the largest malware instances that researchers have found. For instance, the infamous Stuxnet virus that was targeted at Iran?s uranium enrichment facilities several years ago was 500 kilobytes, according to Wired.?

?Flame is a?sizable?beast,? said Graham Cluley of Sophos Security, a publisher of digital security software. ?With all its components in place, it?s approximately 20MB. And this is one of the reasons why people have bandied phrases around like ?biggest? and ?most sophisticated.? Reverse engineering 20MB of code is a?sizable?piece of work.?

Researchers have only scratched the surface of what is hidden in all that code. Stuxnet (and its sister DuQu) took researchers months to figure out exactly what it did and where it might have come from. Flame will take a lot longer.?

Table comparing Flame and Stuxnet from CrySyS at Budapest University of Technology and Economics

Flame, at its core, is spyware. It has the ability to log key strokes from an infected user?s computer, use the computer?s sensors such as the microphone and Web cam to record what is being said around it, and take screenshots. It can also sniff a network to steal passwords, be spread through USB drives and local networks, and transfer data to command-and-control servers. It can infect Windows XP, Vista and Windows 7 computers.?

This is not your ordinary spyware, though. While it does have some simple and basic elements of spyware (which can key log and use the microphone as well), its sheer girth betrays a more sophisticated approach.?

Normal spyware is not hard to detect. It is usually some type of derivation of existing malware that has been repurposed by hackers and distributed through normal channels such as spam or infected websites. Antivirus companies such as Symantec (Norton), Kaspersky, Sophos, Bitdefender and others recognize the spyware shortly after it is discovered and issue a detection kit for it. Microsoft then comes out with a patch and the cat-and-mouse game between the malware writers and security companies goes on. To a certain extent, this is what has happened with Flame. Detection and removal kits have already been released by security companies including Sophos and Symantec, as well as the Iranian government.

But the size and uniqueness of Flame may prove to be more than the antivirus companies realize.?Right now, the detector kits are looking for specific instances within the Flame code to help detect the virus. For instance, code samples with ?flame? or ?wiper? are detected and blocked. The thing is, Flame is not exactly new. It has been in the wild for more than five years, perhaps in varying forms that have been added to over time. Much of Flame may have been compiled in 2011, but bits of it may be older. Flame?s ability to avoid detection over time speaks to its unique properties. Those properties could also speak to its source.

Flame also uses a unique programming language to the malware world: Lua. Lua is used primarily by game developers to create cross-platform applications for iOS and Android. It is similar to C++ but easier to update and communicate with.

?Lua is normally used for convenience,? said Liam O Murchu, operations manager of Symantec Security Response. ?As a scripting language it is much more high-level than C++ and it is easier to write in. Also, it is very easy to update the Lua part of the code and change the behavior of the threat in a very fluid and fast way. Often the Lua portion can be updated without recompiling and redeploying the software in question.?

Flame (sKyWIper) startup sequence from CrySyS

Flame is well organized in how it communicates and translates data. In an infected machine, it can perform a variety of tasks including wiping out its own existence as well as any other malware on the machine. This is a tactic used by other sophisticated viruses ? becoming their own antivirus programs ? presumably because other, less sophisticated viruses could lead to the discovery of Flame itself. When Flame retrieves data, be it key logs or screen shots, it uses high- and low-level encryption and HTTPS to send data back to its command-and-control servers. That data is then organized into its database through MySQLite, a smaller version of MySQL database software.?

In a nutshell: Flame can control almost every aspect of the computer, disappear without a trace, encrypt its own communications and organize the data it collects. That is one smart virus.?

It is so large and smart that researchers have concluded that this was not created by a random group of hackers looking to make some money. (Now that its code is out in the wild, though, that may be part of its future.)?

?The results of our technical analysis supports the hypotheses that sKyWIper [Flame] was developed by a government agency of a nation state with significant budget and effort, and it may be related to cyber warfare activities,? stated a technical report from the Laboratory of Cryptography and System Security (CrySyS) at Budapest University of Technology and Economics.?

Should average computer users worry about Flame? The short answer is no. Kaspersky Labs, which initially reported on Flame, only found several hundred instances of Flame among its client base, most of them in Iran and Middle Eastern countries. Whoever created Flame has been aiming it at specific targets, perhaps knowing that a virus like this left unchecked in the wild could do serious damage.

?I think run-of-the-mill malware is a much more significant threat to the vast majority of computer users than Flame,? Cluley said. ?We have had zero reports of Flame from any of our customers? computers worldwide. Even Kaspersky, who appeared in the first media reports of Flame, only reported a couple of hundred infected PCs. Flame pretty much became the malware you didn?t have to worry about because of the media hoopla and antivirus products being updated in the last 36 hours or so. You imagine that whoever was behind Flame is now pretty grumpy about their malware attracting so much attention.??

Vatican says leaks violated conscience of faithful

VATICAN CITY (AP) ? The Vatican on Tuesday sought to put the widening scandal over leaked documents into a very different light, saying the stolen papers didn't just concern matters of internal church governance but represented the thoughts of people who in writing to the pope believed they were essentially speaking before God.

As a result, Pope Benedict XVI feels particularly pained over the leaks and wants to get to the bottom of the scandal to heal the breach and re-establish a sense of trust among the faithful, according to the Vatican's undersecretary of state, Archbishop Angelo Becciu.

"I consider the publication of stolen letters to be an unprecedentedly grave immoral act," Becciu told the Vatican newspaper L'Osservatore Romano. "It's not just that the pope's papers were stolen, but that people who turned to him as the vicar of Christ have had their consciences violated."

The so-called "Vatileaks" scandal has tormented the Vatican for months and represents one of the greatest breaches of trust and security for the pope in recent memory. Benedict's personal butler has been arrested, accused of theft, after documents he had no business having were found in his Vatican City apartment.

Few think the butler acted alone, and the investigation is continuing on three separate tracks.

The butler, Paolo Gabriele, is due to be formally questioned in the coming days by Vatican prosecutors following his May 23 arrest, Vatican spokesman the Rev. Federico Lombardi said. His lawyers reported that he had pledged to fully cooperate with the investigation to get to the truth, raising the specter that higher ranking prelates may soon be implicated.

The motivations for the leaks remain unclear: Some commentators say they appear designed to discredit Benedict's No. 2, the secretary of state Cardinal Tarcisio Bertone. Others say they're aimed at undermining the Vatican's efforts to become more financially transparent. Still others say they aim to show the 85-year-old Benedict's weakness in running the church.

Becciu said the pope was particularly pained that someone so close to him had been arrested for behavior that was "unjustifiable under any pretext."

"Certainly, the pope feels pity for him," Becciu said. "But still, what has happened was brutal."

"When a Catholic speaks to the Roman pontiff, it's a duty to open yourself up as if you were before God, also because you feel complete guarantees of confidentiality," he said, trying to describe the significance of the leaks to the Vatican.

Lombardi said the scandal was grave enough that Benedict has established a commission of high-ranking cardinals to investigate alongside the criminal investigation and an internal administrative probe.

The cardinals' commission is headed by a heavyweight: Cardinal Julian Herranz, an Opus Dei prelate who headed the Vatican's legal office as well as the disciplinary commission of the Vatican bureaucracy before retiring.

In addition, the pope's personal bodyguard, Domenico Giani, a former Italian secret service agent, has been on something of a crusade tracking down the origin of the leaks in recent months, Vatican insiders report.

"We aren't afraid of the problems, the difficulties and also the errors and guilt that might come out," Lombardi told reporters Tuesday. "We are trying to do the right thing, following a difficult path of truth and taking the necessary measures to reestablish the trust and good functioning of the governance of the church and its institutions."

He said it certainly was a "difficult test" for the pope and his aides but that he hoped that the problems would be identified so that the Vatican can "enjoy the trust of the people God, which the pope certainly merits and we his collaborators must try to support."

The Vatileaks scandal broke in January when Italian journalist Gianluigi Nuzzi broadcast letters from a former top Vatican administrator who begged the pope not to transfer him for having exposed alleged corruption that cost the Holy See millions of euros (dollars) in higher contract prices. The prelate, Monsignor Carlo Maria Vigano, is now the Vatican's U.S. ambassador.

The scandal widened over the following months with documents leaked to Italian journalists that laid bare power struggles inside the Vatican over its efforts to show greater financial transparency and comply with international norms to fight money laundering. There was even a leak of a memo claiming that Benedict would die this year.

The scandal reached a peak last weekend, when Nuzzi published an entire book based on a trove of new documentation, including personal correspondence to and from the pope and his private secretary, much of which paints Bertone in a negative light.

The Vatican has called the publication a "criminal act" and warned of legal action for those who stole, received and disseminated the documents. Nuzzi, who in 2009 published a book on leaked documents from the Vatican bank, has justified the publication as an act of transparency.

In Depth: Get started with keyboard shortcuts in Windows 8

Let's start from the beginning. Windows 8 opens on its lock screen. You can either tap the space bar, spin the mouse wheel or swipe upwards on a touch screen to reveal a regular login screen. Enter your password to begin.

You can later do away with the lock screen; launch GPEdit.msc (the Local Group Policy Editor) and browse to 'Computer Configuration > Administrative Templates > Control Panel > Personalisation'. Double-click 'Do not display the lock screen', select 'Enabled' and click 'OK'.

But the key way to get the most from Windows 8 is to use the keyboard to get around the Metro interface. Press the [Home] or [End] keys to jump from one end of your Start screen to the other, for example, then use the cursor keys to select a particular tile, tapping [Enter] to select it.

It's easy to reorganise, too: press [Win] to return to the Metro screen, then right-click (or swipe down on) apps you don't need and select 'Unpin' to remove them. Why not try sorting your tiles into custom groups while you're at it? You might drag People, Mail, Messaging and Calendar over to the left-hand side, for instance, to form a separate 'Contacts' group.

Click the magnifying glass icon in the bottom right corner of the screen to carry out a semantic zoom, and you can drag and drop the new group around as a block. Right-click within the block (while still in the semantic zoom view) and you'll also be able to give the group a name. This will make it easier to find the tools you need if you go on to add another 20 or 30 apps to your Start screen.

If you're short of time, hold down [Win] and press [Q] (or right-click an empty part of the Start screen and select 'All apps') to see a list of installed applications. Browse the various tiles to find what you need and click the relevant app to launch it. You can also pin these items to the Start screen by right-clicking and selecting the appropriate option. Just type the name of the app if you can't find it in the list.

Master Metro

IE

Metro apps aim to be simpler than old-style Windows applets, which means waving goodbye to menus, complex toolbars and many interface standards. There are usually a few options available on the App bar though, so if you're not sure what to do, right-click an empty part of the screen or press [Win]+[Z] to take a closer look.

The lack of a taskbar can make it hard to find out what's running. Hold down [Win] and press [Tab] to display a pane on the left-hand side of the screen with your running apps. To see this with the mouse, move your cursor to the top left corner of the screen, wait until the thumbnail of one app appears, then drag down. Alternatively, press [Ctrl]+[Shift]+[Esc] to see all your running apps in the Task Manager.

Metro apps don't have close buttons, but apps are suspended when you switch to something else. If Windows needs the system resources, suspended apps will be shut down automatically and will pick up where you left off when they're relaunched. If you want to close down an app anyway, move the mouse cursor up to the top of the screen.

When it changes from the regular mouse pointer to the icon of a hand, hold the left mouse button and drag it downwards. Your app should shrink to a thumbnail, which you can drag off the screen to close it. [Alt]+[F4] also works.

The right-click option is your best friend in Metro. You can use it to get administrator rights, to uninstall apps, and to dismiss applications from the interface entirely. Inside apps Metro's version of Internet Explorer seems to lack a number of major controls. Right-click an empty part of the page and you'll find tabbing options, as well as Refresh, a Find tool, and the ability to pin an internet shortcut to the Start page.

If you're running multiple apps and using a keyboard, use [Win]+[+] to snap an app to the right, or [Win]+[Shift]+[+] to snap to the left. Remember that whatever the interface, you can't snap apps unless your screen resolution is at least 1,366 x 768.

Windows 8 apps can use your name, location and account picture by default. If you're not happy with that, it's easily changed. Press [Win]+[I], click More 'PC settings', select 'Privacy' and click the relevant buttons to disable any details you'd rather not share.

Install anything

GPEdit

Most mobile platforms recommend you only install apps from approved sources, and Windows 8 is the same: it'll only allow you to install trusted (digitally signed) apps from the Windows store. If you're willing to take the security risk (this isn't something to try unless you're entirely sure it's safe), then the system can be configured to run trusted apps from any source.

Launch GPEdit.msc, browse to 'Computer Configuration > Administrative Templates > Windows Components > App Package Deployment', then double-click 'Allow all trusted apps to install' and select 'Enabled > OK'.

While you're at it, open the Metro Settings panel (press [Win]+[I]), click 'Settings', change 'Show administrative tools' to 'Yes' and click on an empty part of the Start screen. It's as simple as that. Scroll to the right and you'll find a host of new tiles for various key applets - Performance Monitor, Event Viewer, Task Scheduler, Resource Monitor and more - ready to be accessed at a single click.

The Gold River Runs Red (Realistic Western)

Hi!

I am looking for people to fill in the slots of the Outlaws, Sheriff, and Deputies. If you are interested in a real Western RP (No steampunk, magic, etc), then please do take part.

The story is fictional, as in setting, but all of the rest is made to be factual of that time period. The backdrop is that this small town discovered gold in one of its rivers, however, the largest sum of it is found in Indian territory. There will be adventures, and (for lack of a better term) quests to achieve financial wealth and a name. So far I have two characters down, and I would like more.

Natives can also be played, or they will be NPC'ed. Truth me told, I would rather have people play them rather than do all of the work myself. That is a lot of controlling.

At the moment, I could use the Outlaw slots being taken up. Their names are horrific (I know this), and they can be changed to the will of the typists that take them. If not, they will remain the same.

3DS Mod - Can Debtors Afford Bankruptcy? Finding LowCost ...

There appears palpably inside the environment, one ominous more burden for the average intensely indebted American debtor and consumer inside todays dire nationwide financial conditions whom will perhaps see his only recourse for several relief, inside filing bankruptcy: acquiring low-cost bankruptcy, acquiring low-cost bankruptcy which you can afford. Meaning, inside essence, a non-lawyer professional se alternative.

The current figures just released by the Administrative Office of the U.S. Bankruptcy Courts on the February 2009 bankruptcy filings, made one vital fact crystal well-defined to nearly every one, namely, which the pace at which the increasingly overburdened and restive American borrowers both people and businesses are filing for bankruptcy, is at its highest degrees since the now-famous or infamous, many would state! draconian changes of 2005 to the U.S. bankruptcy law. However, actually more greatly, which the new filing rate is ominously beginning to return to the older ?hated? excellent bankruptcy filing degrees which the country had hit before which new law was passed inside 2005, supposedly meant to correct and drastically curtail or reverse the then pre-existing excellent filing degrees.

This current trend inside American debtor bankruptcy filings strongly underscores a limited fundamental things, and others. First, the detail and gravity of the financial straights and difficulties inside that the average American consumer and debtor is in today. Second, the fact which, regardless how complicated a legal challenge and hindrance the institutional powers which be the Congress, the lawyers, or the financial institutions, the courts, etc will try to put on the route of the American borrowers to try discouraging or creating it more challenging to them inside seeking the bankruptcy relief of their debt problems, whenever it really comes time of dire financial and financial crisis, Americans may somehow nonetheless find a way, and may nonetheless persevere and persist actually against all chances, inside demanding their constitutional liberties to be heard inside bankruptcy; and thirdly, the critical necessity, for the average debtor, for acquiring low-cost bankruptcy filing alternatives to representative.

Elizabeth Warren, a Harvard Law School professor and author of several books on bankruptcy, probably sums up the aim best this technique, alluding to the persuasion of the Congress by various particular interests to pass the 2005 law which restricted borrowers from filing for bankruptcy: ?The credit business [and other vested interests] did its best to drive up the price of filing [for bankruptcy]. But when families are inside sufficient trouble, they may battle their technique from the paper ticket and higher attorneys costs to get aid,? adding which ?The term has become leaking out [once again] which the bankruptcy courts are open for business.?

THE ?UNOFFICIALLY BANKRUPT DEBTORS? ? DEBTORS WHO CANT FILE BECAUSE THEY CANT AFFORD IT

But, actually many importantly than which, within the standpoint of the average bankruptcy-seeker today, this raises one fundamental queries, however. Namely, just how do the present growing army of increasingly despairing American borrowers whom not merely seek to file for individual or business bankruptcy, employing a lot of cases, truly NEED to file one, AFFORD to file bankruptcy ? inside certain, the excellent lawyers legal expense of filing for bankruptcy? How do these borrowers get or find low-cost bankruptcy? A bankruptcy which borrowers may reasonably afford?

Some one.1 thousand one,064,000 American borrowers recorded for bankruptcy this past 2008 year ? filings that, many analysts are rapid to prompt us, were carried out by these borrowers despite, and below tough conditions of, a whole host of stringent, restrictive specifications and drastically improved legal costs imposed by the 2005 law. But, actually more immense, within the stand aim of the debtor or bankruptcy-seeker, is another closely connected FACT: which, worse nonetheless, according to specialists, THERES NEARLY AS MANY AMERICAN DEBTORS MORE whom planned to file for bankruptcy and are suitable, however, can not, considering they merely couldnt AFFORD the lawyers legal costs. These are borrowers whom Justin Harelik, a bankruptcy representative with Price Law inside Los Angeles, call the ?unofficially bankrupt debtors? ? borrowers that are all however, bankrupt however, just shortage the lawyers significant cost to create their status official!

EVEN THE LAWYERS AGREE, THEIR BIG FEES IS A PROBLEM WITH DEBTORS

In deed, though many bankruptcy lawyers would quite it be sugar-coated, other lawyers, themselves, objectively acknowledge which the lawyers legal costs for bankruptcy is a principal frequent problem and concern to borrowers and clients inside bankruptcy law follow.

?You need to pay the Chapter 7 legal costs upfront inside cash. You are able to be too poor to go bankrupt,? is how Professor Robert M. Lawless of the University of Illinois College of Law once said.

Another observer, Jenny C. McCune, a contributing editor at Bankrate.com, notes which quite astoundingly, weve today come to the aim where a debtor will have to ?finance bankruptcy filing,? adds: ?It will sound like a Catch-22?you have zero money thus youre filing for bankruptcy, however you want [legal fee] money thus you can file for bankruptcy.?

Jonathan Ginsburg, bankruptcy lawyer, Atlanta, Ga., explains which inside phone conversations he usually has with callers facing extreme financial crises that are thinking potential bankruptcy, following their first doubt that is usually general inside type, ?The upcoming doubt I get has to do with fees: If I have zero money, how am I imagined to pay for a representative??

LAWYERS TRADITIONAL ARGUMENT FOR THEIR HIGH FEES

Bankruptcy lawyers, schooled inside the art of argumentation and the defense of actually the clearly indefensible, very whenever it centers on the security of a profitable signifies of creating a lifestyle, would usually plunge into what, inside essence, are really deep philosophical reasons inside justification of the excellent costs they charge ? it is actually really nonetheless a ?bargain? for borrowers, thinking about the much larger sums they stand to discharge inside bankruptcy; if your debtor is ?really? hard pressed sufficient by his debt burden and is ?serious? regarding freeing himself of it, hell somehow find a way; a debtor, when he or she is absolutely ?serious,? may always find the lawyers costs around by, state, withholding the installments he would have had to create to different lenders and then utilizing it to pay the representative to free him of the bigger debt burden, etc., etc. It is a complex web of reasons that would have to wait for a later date to address. However, for our present immediate purposes inside this particular article, the relevant problem is crystal well-defined. The aim, clearly, is the fact that for the average American debtor today, already bringing within the excellent debt burden that is the prime object hes out trying to address from bankruptcy filing, the average lawyers fee for bankruptcy several $2,000 or more for the easiest Chapter 7 bankruptcy, and $4,500+ for its Chapter 13 counterpart is excellent, inside deed actually excessive, and frequently is just plain beyond his signifies ? in a word, merely UNAFFORDABLE.

LAWYERS FEES HAVE ?PRICED OUT? A LOT OF DEBTORS

Seems which the bankruptcy lawyers, from greed and monopolistic instinct, are gradually pricing themselves from the individual bankruptcy filing business, which truly the only realistic alternative today left to be tried, appears to become a non-lawyer low-cost bankruptcy alternative.

?Surveys have shown which many attorneys have doubled their costs to deal with new specifications imposed by the BAPCPA of 2005. Many thousands of borrowers have consequently been priced from representative representation inside their bankruptcies,? claims Stephen Elias, a California lawyer and bankruptcy professional and author of several books on the subject. ?Because of rules regulating the follow of law, truly the only legal substitute for lawyer representation is self representation? bankruptcy petition preparers may assist with your paperwork.?

The aim then is crystal well-defined. The fundamental task at hand this extremely minute inside the field of bankruptcy, is devising a trustworthy program which is low-cost for filing bankruptcy, that is simple, simple, and readily accessible, and is, most importantly, AFFORDABLE to many borrowers whom legitimately seek or want bankruptcy and are qualified and suitable to file inside the given eligibility rules. It is, in the end, no ?gift? or some sort of ?favor? being meted out by ?the law,? or some sort of mercy-peddling do-gooders of the legal establishment. But, a direct sacred correct and present of the American Constitution.

It is a task that confronts us all, very the bankruptcy constituency and the bankruptcy business powers-that-be whom control the present bankruptcy program ? the financial and credit business, the courts, the Congress, however, including personal entrepreneurs and inspirations persons who is able to come up with new or fresh inspirations regarding how to correct the present broken individual bankruptcy program, and yes, the present bankruptcy lawyers and bar, and others.

But, of more immediacy and urgency inside the mean time, however, whilst you wait such a new program to be designed by the trustworthy parties, qualified American entrepreneurs, institutions and entities that are able, ought to be complimentary to create useful and beneficial means and methods ? alternatives to the present wholly deficient and limited lawyer-controlled bankruptcy program ? that allow legitimate bankruptcy seekers to exercise their legitimate constitutional correct to seek the bankruptcy relief alternative whenever and when mandatory ? merely and AFFORDABLY.

IN SUM

The point is the fact that, America, inside both its public and also personal fields, should quick prepare for, and create and apply, a drastically different however, beneficial bankruptcy filing program which provides the present thousand plus every year and the upcoming more millions of bankruptcy filers whom may be coming into the bankruptcy filing pipeline every year, a genuinely low-cost signifies to them to file for bankruptcy ? the one.4 thousand American filers or more which need to seek the bankruptcy relief inside 2009 calendar year alone, and beyond.

NEED FOLLOW-UP INFORMATION?
